LEGO Serious Play no ensino jurídico
Resumo
O ensino jurídico não vem acompanhando completamente as significativas mudanças da
sociedade no século XXI e isso determina expressiva falta de motivação dos alunos. As
metodologias de ensino usadas nos cursos jurídicos continuam baseadas na autoridade e saber
do professor e dos livros, pautadas, principalmente, no instrucionismo e na pedagogia. Este
trabalho apresenta como problema central, então, a análise de metodologia de ensino
inovadora que pode contribuir para a superação do desinteresse e da falta de motivação e
participação de muitos alunos dos cursos jurídicos. A pesquisa se desenvolve a partir dos
seguintes temas: qual é o papel do Direito e como os cursos jurídicos desenvolvem o ensino e
os propósitos essenciais do Direito atual; como despertar o interesse dos discentes e quais os
aspectos fundamentais para a retomada do empenho e aprendizado efetivo dos alunos; como
alcançar um Direito aplicável às realidades e demandas atuais da sociedade. Parte-se, assim,
da premissa da necessidade de mudanças dos métodos e metodologias do ensino jurídico do
Brasil, a fim de mitigar o problema central desenvolvido nesta pesquisa, demonstrando,
inclusive, alguns dos resultados obtidos ao longo da construção deste trabalho científico,
evidenciados pelos resultados de experiências docentes que trabalharam a atuação conjunta do
arraigado instrucionismo, com o construtivismo e o construcionismo; bem como da pedagogia
com a andragogia; além da importância da razão, emoção, inovação, criatividade, o uso de
imagens e dos jogos no ensino do Direito. Sob esta perspectiva, a pesquisa se desenvolve a
partir dos marcos teóricos do Código Civil e do método de ensino LEGO Serious Play (LSP),
desenvolvido por Per Kristiansen e Robert Rasmussen. O método LSP pode ser aplicado em
qualquer disciplina do Direito, bem como em outras Ciências, mas por aspectos
metodológicos e por delimitação do tema, os exemplos aqui desenvolvidos pautar-se-ão
substancialmente no ensino do Direito de Família. Portanto, inaugura-se este estudo não tendo
a intenção de encerrar todas as questões que envolvem a matéria. A expectativa é que este
trabalho seja útil à comunidade jurídica e à sociedade, ao reunir importantes métodos e
soluções aplicáveis ao ensino jurídico efetivo e capaz de transformar a atividade profissional,
a fim de contribuir para um Direito que acompanhe as transformações e os anseios da
sociedade e dos discentes do século XXI. Reforça-se, assim, a necessidade do
desenvolvimento e a aplicação de novas metodologias e métodos de ensino, que favoreçam a
mudança do modelo mental dominante, o pensamento sistêmico, a inovação e a solução de
problemas reais que motivem os alunos para o aprendizado. O LEGO Serious Play cumpre
essas funções e precisa ser compreendido e utilizado pelos profissionais do Direito. The Law education has not been following the significant changes of society in the 21st
century and this determines a significant lack of student motivation. The teaching
methodologies used in legal courses continue to be based on the authority and knowledge of
the teacher and the books, based mainly on instructionalism and pedagogy. This presents
work as central problem, the analysis of methodology of innovative teaching that can
contribute to overcoming the lack of interest and the lack of motivation and participation of
many students of legal courses. The research develops from the following themes: what is the
role of the Law and how the legal courses develop the teaching and the essential purposes of
the current Law; how to arouse the interest of the students and what are the fundamental
aspects for the resumption of commitment and effective learning of the students; how to
achieve a Law applicable to the current realities and demands of society. Thus, it is necessary
to change the methods and methodologies of Brazilian legal education, in order to mitigate the
central problem developed in this research, demonstrating some of the results obtained during
the construction of this scientific work, evidenced by the results of teaching experiences that
worked the joint action of deep rooted instruction, with constructivism and constructionism;
as well as pedagogy with andragogy; besides the importance of reason, emotion, innovation,
creativity, the use of images and games in the teaching of Law. From this perspective, the
research develops from the theoretical landmarks of the Civil Code and the LEGO Serious
Play (LSP) teaching method developed by Per Kristiansen and Robert Rasmussen. The LSP
method can be applied in any discipline of law, as well as in other sciences, but by
methodological aspects and by delimitation of the subject, the examples developed here will
be based substantially on the teaching of Family Law. Therefore, this study is inaugurated not
having the intention to close all the issues involving the article. It is expected that this work
will be useful to the legal community and society, by bringing together important methods
and solutions applicable to legal education effective and able to turn professional activity, in
order to contribute to a right to accompany the transformations and the aspirations of society
and of the students of the 21st century. Reinforces the need for the development and
application of new teaching methodologies and methods, favouring the dominant mental
model changes the systems thinking, innovation and the solution of real problems that
motivate students to learn. The LEGO Serious Play fulfills these functions and needs to be
understood and used by legal professionals.
