FGTS: afinal interessa a quem? Assimetrias funcionais a luz de sua origem, correção e destinação

Abstract

O presente estudo analisa o Instituto do FGTS no Brasil desde a sua origem e construção até sua finalidade e interesse. Analisando-se esse importante Instituto é possível verificar que a sua origem se deu para substituir a estabilidade de emprego existente à época, contudo, ao passar dos tempos percebe-se que houve o desvirtuamento da finalidade, tendo sido utilizado para manobras de governo, investimentos em áreas diversas por parte do órgão gestor, e não mais proteção do emprego e sua estabilidade. Analisa-se o Instituto em sua amplitude, e com isso, é possível verificar Institutos análogos no direito estrangeiro, como União Europeia e Mercosul, assim como a organização internacional do trabalho OIT. Analisa-se ainda a administração e origem do FGTS e como o órgão gestor dos fundos e recursos financeiros que compõem o FGTS e a importância do fundo como fomento para a economia. Tem-se como a principal foco a análise das correções do FGTS ao longo dos anos, e como a atualização pela taxa referencial é prejudicial aos trabalhadores, uma vez que a inflação é muito superior ao rendimento desse fundo. Para isso analisa-se os índices de correção monetária do fundo e a defasagem dessas correções ao longo dos anos de 1999 em diante.

This study analyzes the FGTS Institute in Brazil since its inception and construction to its purpose and interest. Analyzing this important institute is possible to verify that its origin was given to replace the existing employment stability at the time, however, the passage of time it is noticed that there was distortion of the purpose, having been used for government maneuvers, investments in several areas by the governing body, and no more job protection and stability. Analyzes the institute in its scope, and with it, you can see similar institutions in foreign law, as the European Union and Mercosur, as well as the international organization of the ILO's work. It also analyzes if it administration and origin of the FGTS and as the governing body of the funds and financial resources that make up the FGTS and the importance of the fund as encouraging for the economy. it has as main focus the analysis of corrections FGTS over the years, and how to update the reference rate is harmful to workers, since inflation is much higher than the income of the fund. For this we analyze the monetary correction rates of the fund and the gap of these fixes over the years 1999 onwards.
