Ações afirmativas e acessibilidade como instrumentos de efetivação do princípio da igualdade para as pessoas com deficiência

Abstract

O presente trabalho relata as fases históricas e a evolução do tratamento político e social destinado à pessoa com deficiência, desde a Antiguidade até a "Declaração dos Direitos dos Deficientes" e demais legislações pertinentes, tanto anteriores como posteriores às Constituição Brasileira de 1988. Descreve alguns aspectos sobre Direitos Humanos e identifica o Princípio da Igualdade, como princípio basilar e de ordem constitucional. Também apresenta mecanismos efetivação dos direitos sociais, tais como as ações afirmativas, que têm o condão de incluir as pessoas com deficiência na sociedade e cessar o processo de exclusão, historicamente imposto a este referido grupo minoritário.

This paper describes the historical phases and the evolution of political and social treatment for the disabled person, from antiquity to the "Declaration of the Rights of Disabled People" and other relevant laws, both before and subsequent to the 1988 Brazilian Constitution. Describes some aspects on Human Rights and identifying the Principle of Equality, as an overarching principle and constitutional. And presents effective mechanisms of social rights, such as affirmative action that have the power to include people with disabilities in society and cease the deletion process, tax historically referred to this minority group.
